After Mitchell gave her reasons Monday morning, Guerra Guerra and his parents sobbed at the news that he would be going home.
Guerra Guerra, Emily Altmann, 22, and Dylan Schapp, 22, were charged with second-degree murder in the death of Josue Silva, 18, who was shot to death at a bush party near Pack Road and Grand Oak Crossing in southwest London on July 31, 2021.
Guerra Guerra also faces charges of assault with a weapon causing bodily harm, obstructing justice, intimidation and uttering threats. He has been in custody since his arrest on Aug. 7, 2021.
The evidence at the bail hearing and Mitchell’s reasons are under a publication ban.
Guerra Guerra’s release comes four months before he and Altmann begin a nine-week trial in London on Oct. 21. Schapp pleaded guilty to manslaughter and assault with a weapon last month but no facts or findings of guilt have been entered onto the court record. His sentencing date is set for Aug. 13.
Schapp remains in custody, but Altmann was granted bail in October 2021, two months after her arrest. Her parents pledged $200,000 without deposit and Altmann is living with them under house arrest.

She was ordered to wear an ankle monitor and prohibited from using the internet unless under supervision for court appearances, meeting with her lawyer and educational classes.
Silva was a gifted student-athlete who was studying business at Western University. He was about to enter his second year and was working two summer jobs at the time of his death.
Silva was found by emergency responders with a gunshot wound around 1:15 a.m. and was taken to hospital without vital signs.
Superior Court Justice Helen Rady denied Guerra Guerra’s release in November 2021. He applied for a bail review in front of Superior Court Justice Bruce Thomas in May 2022 and was denied a second time.
HIs most recent review was held over three days in London in June in front of Mitchell.
The bail conditions, which amount to a full house arrest, include Guerra Guerra’s mother pledging $300,000, his father pledging $40,000 and a family friend pledging $25,000 as no-deposit securities.
Guerra Guerra is barred from communicating with the two co-accused and a list of other people filed with his bail order.
